POSITION DESCRIPTION

This position provides management and direction over the courts of the Fallon Paiute-Shoshone Tribe and is responsible for program development, policy formulation and recommendations, and the management of timely and sensitive daily operations at a key point in the system.  This position also handles the duties of a court clerk as needed.

ESSENTIAL DUTIES & RESPONSIBILITIES

  1. Develops, evaluates, and implements policies and procedures to meet department goals and objectives; coordinates the activities of the various programs operated by the department to ensure timely, efficient, and effective delivery of services; evaluates operational effectiveness and efficiency; identifies need for and leads studies and research in areas such as defendant demographics, rates of success, and best practices; develops strategic operating plans.
  2. Supervises staff as needed, including reviews and evaluates staff performance; administers discipline for inadequate performance and improper behavior.
  3. Ensures compliance with laws, policies, trial/hearing standards and directives; maintains written operations manual; maintains quality control processes in delivery of all services; recommends modification of policies when necessary.
  4. Interacts with the Fallon Business Council to advocate for Court Services; coordinates and improves services; educates the community about court services.
  5. Maintains and oversees the records of the court ensuring completeness and accuracy; researches tribal court criminal history of arrestees; screens for indigent status to determine eligibility for appointed counsel; verifies information; determines eligibility for any court diversion programs.
  6. Manages fiscal activities by preparing and administering the department budget; allocates resources and controls and authorizes expenditures; reviews financial and statistical reports to monitor program performance and resource usage.
  7. Responds to program questions from the court; interacts with judges and other court/legal professionals; provides advice on complex issues; serves as a liaison with court administration and operations staff in other government agencies.
  8. Makes verbal and written presentations to the Courts and to other public and private groups; represents the department with other government agencies and in meetings with the public.
  9. Instructs and notifies parties as to timing of court appearances; prepare dockets or calendars of cases to be called; prepare documents recording the outcomes of court proceedings; prepare/mark all applicable court exhibits and evidence; examine legal documents submitted to courts for adherence to laws or court procedures
  10. Prepare courtrooms with requested supplies and ensure that recording equipment is working
  11. Swear in jury members, interpreters, witnesses, and defendants
  12. Prepare and issue notices/orders of the court, including judgments, subpoena’s, notices of hearing, probation orders, release documentation, sentencing information and summonses; record case dispositions, court orders, and arrangements made for payment of court fees
  13. Ensure that court notices/orders are timely served and that parties in cases are aware of all appropriate deadlines which are applicable to the case.
  14. Other duties related a court clerk position as assigned by the Chief Judge of the Tribe during any judicial proceedings/actions of the tribal courts.
  15. Other job-related duties as assigned by the supervisor.

KNOWLEDGE, SKILLS & ABILITIES

  1. Bachelor’s Degree from an accredited college in criminal justice or a related field or at least 5 years’ experience in leading, directing, managing, implementing a justice department or court system; and specific knowledge and understanding about the Court Services field.
  2. Preference will be given to applicants with past experience in managing/directing a judicial, justice, or court system of an Indian Tribe.
  3. THIS POSITION REQUIRES COMPLIANCE WITH THE INDIAN CHILD PROTECTION and FAMILY VIOLENCE PREVENTION ACT PUBLIC LAW 101-630; 25 CODE of FEDERAL REGULATIONS PART 63 – INDIAN CHILD PROTECTION and FAMILY VIOLENCE PREVENTION; CRIME CONTROL ACT OF 1990, EMPLOYEE BACKGROUND CHECKS; and EXECUTIVE ORDER 12968, ADJUDICATIVE GUIDELINES AND THEREFORE MUST SUCCESSFULLY COMPLETE AN EXTENSIVE BACKGROUND CHECK BEFORE START EMPLOYMENT.
  4. Knowledge of basic principles of finance and budget management.
  5. Knowledge of data management and evaluation techniques.
  6. Knowledge of information technology services in managing a program.
  7. Knowledge of the functioning of the courts and tribal/legal judicial systems.
  8. Knowledge of court trial and hearing operations/procedures.
  9. Knowledge of laws, statutes, and national and state trial/hearing standards
  10. Knowledge of administrative management principles and practices.
  11. Knowledge of supervisory principles, practices, and methods.
  12. Skill in developing, implementing, and administering goals, objectives and procedures.
  13. Skill in planning, developing, implementing and monitoring policies, procedures, rules and regulations.
  14. Skill in effectively supervising, leading, and delegating tasks and authority.
  15. Skill to coordinate activities across systems
  16. Skill in establishing and maintaining effective working relationships with superiors, subordinates, department heads, various individuals within the court system, and the general public.
  17. Skill in effective verbal and written communications.
  18. Skill in conflict resolution and mediation techniques
  19. Skill in the operations of a personal computer and various software applications.
  20. Ability to maintain confidentiality.
